Waiting Time Exemption
To enable the pausing of the shift clock for drivers, you can activate a Waiting Time exemption. This duty status will be represented by a dotted line in the Off Duty row.
The waiting time exemption is outlined in accordance with §395.1(d) and pertains to oilfield operations as follows:
- Oilfield Operations: (1) For drivers of commercial motor vehicles exclusively involved in transporting oilfield equipment, including stringing and picking up pipe used in pipelines, and servicing field operations in the natural gas and oil industry, an 8-consecutive-day period may conclude with the commencement of any off-duty period lasting 24 hours or more.
- (2) Specially trained drivers of commercial motor vehicles designed for servicing oil wells are exempt from counting waiting time at a natural gas or oil well site as on-duty time. Instead, such waiting time should be recorded as "off duty" for compliance with §§395.8 and 395.15. This can be indicated with remarks or annotations specifying the off-duty periods as waiting time, or on a separate "waiting time" line on the record of duty status. Waiting time is not factored into the calculation of the 14-hour period as per §395.3(a)(2). It's important to note that specially trained drivers of such commercial motor vehicles are not eligible to use the provisions of §395.1(e)(1).
