Cancellation, Refunds and Returns

1. Cancellation charges (Commitment & Termination)

1.1 If the customer ends their subscription before the agreed term ends (e.g., cancelling a 12-month contract after 6 months), Advaya can charge the customer’s payment method for the fees due for the remaining subscription period. If Customer is eligible for any refunds after termination of its subscription services, any such refund will only be processed by Advaya. The contract terms will stay in effect until they are ended as explained here. The contract period for the subscriptions listed in the order form will automatically extend for additional “n” month periods (each called a ‘Renewal Term’) at the regular renewal rate unless the customer notifies Advaya team at least 15 days before the renewal date that they do not wish to renew. The customer is accountable for all fees up to the end of the current contract period.

1.2 Autopay : Customer subscriptions will automatically renew at the conclusion of the chosen Subscription Term. The renewal payment for Customer subscriptions will be automatically charged to the default credit card, debit card, or other payment method on file. For annual or longer-term subscriptions, renewal will occur for consecutive 12-months period, while for monthly/quarterly subscriptions, renewal will happen for consecutive 1 and 3 month periods.

Note – Customer acknowledges that Advaya can charge the customer’s credit card for any necessary fees, including Replacement Fees or Restoration Fees. We use a third-party payment processor, and the customer’s use of the payment processing service is subject to the terms and conditions and privacy policy of the payment processor. Advaya will have the authority to periodically impose charges (e.g., monthly fees, renewals, additional orders, and fees) without requiring additional consent from the customer. This will continue until the customer provides advance notice (15 days prior to next billing date) expressing their intention to terminate this authorization or change the payment method. Any such notice will not impact charges submitted by Advaya.

1.3 Cancellation Prior to Automatic Renewal : If Customer wants to cancel before automatic renewal, Customer must contact Advaya Support team at support@advayafleet.com or 209-255-7777.

2. Refund policy (Prime)

2.1. Refund Eligibility:

  • Full subscription refund will be initiated for the ELD Prime Device.
  • The customer has a 30-day window from the date of purchase to request a refund.

2.2 Condition of the Device:

  • The ELD device should be in its original condition.
  • All accessories, manuals, and packaging must be included.
  • The device must be unused or only lightly used.

2.3. Return Shipping: – The customer is responsible for bearing the cost of return shipping.

2.4. Non-Returnable and Non-Refundable Items:

  • Shipping costs are non-refundable.
  • Adapters/cables are also specified as non-returnable and non-refundable.

2.5 Charges for Unreturned/Damaged/lost hardware (Prime) : If the customer fails to return the hardware or returns it in a damaged condition or it is lost, Advaya reserves the right to charge fees for the unreturned, damaged or lost hardware ($150), known as Return Fees or replacement fees.

It’s important for customers to adhere to these conditions to qualify for a refund. If there are any questions or concerns, customers may want to contact customer support at support@advayafleet.com.

Note – For any other Hardware device (Advaya Advanced/Dashcam) –

Those will be non-refundable and non-returnable which means that once a customer purchases a hardware product, they cannot seek a refund or return the item for any reason. Customers can simply request for subscription cancellation 15 days prior to the next billing date.
