Exemptions for Adverse Driving Conditions within a Fleet
Granting eligibility for the Adverse Driving Exemption can be based on unforeseen traffic or weather conditions, as outlined in §395.1(b). The utilization of this exemption results in the following outcomes:
- Extension of the Drive limit clock by 2 hours, extending it from 11 to 13 for Property drivers or from 10 to 12 for Passenger drivers.
- Extension of the Shift limit by 2 hours, extending it from 14 to 16 for Property drivers and from 15 to 17 for Passenger drivers. It is important to note that this exemption applies exclusively to the Federal Property and Passenger rulesets.
- A distinctive banner is displayed on the Hours of Service (HOS) log, signaling the activation of the exemption.
- Both claimed and unclaimed events trigger a notation in the HOS log.
When a driver claims this exemption, they have the option to enter a remark, providing an explanation that will be visible in the log and the Electronic Logging Device (ELD) Data File.
